Telaah Hadist Nabi Tentang Mediasi Rumah Tangga Dalam Hukum Islam Kontemporer

Family is a basic institution in Islam that plays an important role in shaping the character and values of people's lives. In dealing with domestic conflicts, Islam does not immediately recommend divorce, but emphasizes the importance of peaceful resolution through mediation (ishlah). This study aims to examine the understanding of the Prophet Muhammad's sunnah in domestic mediation through a review of relevant hadiths, and to analyze its implementation in the Islamic family law system in Indonesia. The method used is a literature study (library research) by reviewing relevant hadiths and legal regulations such as the Compilation of Islamic Law, the Marriage Law, and PERMA No. 1 of 2016. The results of the study show that the practice of mediation exemplified by the Prophet SAW emphasizes the principles of compassion, deliberation, empathy, and justice in resolving disputes. These principles have been normatively accommodated in the Islamic family law system in Indonesia, but their implementation still faces various challenges, such as the dominance of a legalistic approach, limited mediator capacity, and minimal public understanding of the concept of hakam. Therefore, it is necessary to strengthen the mediation approach based on the values of the Prophet's Sunnah as an effective peaceful solution in maintaining household integrity and social stability.
Abstrak
Keluarga merupakan institusi dasar dalam Islam yang memiliki peran penting dalam membentuk karakter dan nilai kehidupan masyarakat. Dalam menghadapi konflik rumah tangga, Islam tidak serta-merta menganjurkan perceraian, melainkan menekankan pentingnya penyelesaian secara damai melalui mediasi (ishlah). Penelitian ini bertujuan untuk mengkaji pemahaman sunnah Nabi Muhammad SAW dalam mediasi rumah tangga melalui telaah hadis-hadis yang relevan, serta menganalisis implementasinya dalam sistem hukum keluarga Islam di Indonesia. Metode yang digunakan adalah kajian pustaka (library research) dengan menelaah hadis-hadis relevan serta regulasi hukum seperti Kompilasi Hukum Islam, Undang-Undang Perkawinan, dan PERMA No. 1 Tahun 2016. Hasil penelitian menunjukkan bahwa praktik mediasi yang dicontohkan oleh Nabi SAW menekankan prinsip kasih sayang, musyawarah, empati, dan keadilan dalam menyelesaikan perselisihan. Prinsip-prinsip ini secara normatif telah diakomodasi dalam sistem hukum keluarga Islam di Indonesia, namun penerapannya masih menghadapi berbagai tantangan, seperti dominasi pendekatan legalistik, keterbatasan kapasitas mediator, dan minimnya pemahaman masyarakat terhadap konsep hakam. Oleh karena itu, diperlukan penguatan pendekatan mediasi yang berbasis pada nilai-nilai sunnah Nabi sebagai solusi damai yang efektif dalam menjaga keutuhan rumah tangga dan stabilitas sosial.
