Abstract

This study aims to formulate legal guidelines for gadget use from an Islamic law perspective by integrating the principles of maqāid al-sharīʿah with the moral theories of Wael B. Hallaq and Khaled Abou El Fadl. The research problem is predicated on the need for clear moral guidance in the digital era, addressed through three research questions: what moral principles form the legal foundation, what factors necessitate them, and what are their legal implications. This study employs a qualitative method with a descriptive-analytical approach. Data were collected through a literature review of primary sources (the Qur’an, Hadith, and the works of Hallaq and El Fadl) and secondary sources. Data analysis was performed using the Miles and Huberman model, combined with an interpretive approach. The findings indicate that the law governing gadget use must be grounded in a morality rooted in maqāid al-sharīʿah to balance individual freedom with the public interest (malaah). Key principles include moral responsibility and the integration of spiritual-ethical values, driven by the moral disorientation of modernity and the need for adaptive law. The implication is the formation of a responsive and ethical legal framework to foster a responsible digital culture.

Abstrak

Penelitian ini bertujuan merumuskan panduan hukum penggunaan gadget dalam perspektif hukum Islam dengan mengintegrasikan prinsip maqasid al-shariah serta teori moralitas Wael B. Hallaq dan Khaled Abou El Fadl. Latar belakang masalah adalah kebutuhan akan panduan moral yang jelas di era digital, yang dijawab melalui tiga pertanyaan penelitian: prinsip moralitas apa yang menjadi landasan hukum, faktor apa yang mendorongnya, dan bagaimana implikasinya. Penelitian ini menggunakan metode kualitatif deskriptif-analitis, dengan data yang diperoleh dari kajian literatur sumber primer (Al-Qur'an, Hadis, karya Hallaq dan El Fadl) dan sekunder. Analisis data dilakukan melalui model Miles dan Huberman yang dikombinasikan dengan pendekatan interpretatif. Hasil penelitian menunjukkan bahwa hukum penggunaan gadget harus berlandaskan pada moralitas yang berakar pada maqasid al-shariah untuk menyeimbangkan kebebasan individu dan kemaslahatan umum (maslahat). Prinsip-prinsip utamanya mencakup tanggung jawab moral dan integrasi nilai spiritual-etis, yang didorong oleh disorientasi moral modernitas dan kebutuhan akan hukum yang adaptif. Implikasinya adalah terbentuknya kerangka hukum yang responsif dan etis untuk menciptakan budaya digital yang bertanggung jawab.
